Biwin Hit with $50M Patent Suit from Longsys Affiliate Amid IPO

On April 8, Biwin Storage announced two new patent infringement lawsuits from EMT Storage Technology (Shenzhen), seeking a total of RMB 50 million ($6.9M). The suits come as Biwin pursues a Hong Kong IPO.

EMT is a joint venture between U.S.-based MTL and Longsys’ wholly-owned subsidiary AnjieCun. MTL is known as a patent assertion entity.

This is the third round of legal attacks in nearly a year:

  • June 2025: Longsys subsidiary sued Biwin for ~RMB 1.21M (later dropped)

  • Sept 2025: EMT first sued Biwin (still ongoing)

  • April 2026: EMT adds two more cases, claim jumps 41x to RMB 50M

The patents (ZL201510093389.3, ZL200980106241.1) expire in 2029 and cover eMMC standard essential patents. EMT alleges Biwin’s eMMC products infringe.

Biwin’s response: strong defense – questioning SEP status, denying infringement, filing for patent invalidation with CNIPA. It claims business is unaffected and the suits will not materially impact profits.

Biwin filed for H-share listing in Sept 2025 and is now in a critical review period. The consecutive lawsuits are widely seen as industry tactics to disrupt its IPO.
